Falun Gong Practitioner Mr. Lu Jinyou Sentenced Twice, Files Second Appeal

Practitioner Mr. Lu Jinyou from Zhuozhou city, Hebei Province was arrested by the Zhuozhou city police more than one year ago. He was sentenced to three years in prison by the Zhuozhou Municipal Court, and a final verdict was approved by the Baoding City Intermediate People's Court. Mr. Lu Jinyou rejected the sentence and has appealed to the Hebei Provincial Higher People's Court as of February 26th.

In Mr. Lu Jinyou's appeal letter, he demands that the Provincial Higher People's Court revoke the final verdict, give him a new trial, and make a fair judgment.

He also demands that the courts repair the social impact caused by the framing of Falun Gong practitioners and restore their reputation; that the two courts compensate the complainant for the economic losses and mental anguish caused by the wrongful sentencing; and that the two courts' criminal responsibility be investigated for using the Chinese Communist Party and legal forms to sabotage the correct implementation of Chinese law.

Mr. Lu is approximately 59 years old and lives in Han Village in Songlindian Town, Zhuozhou City, Hebei Province. He began practising Falun Gong in 1998 and greatly benefited mentally and physically, so he frequently tells people of the benefits he achieved from practising.

Mr. Lu Jinyou was arrested in his home on August 5th 2010 by police officers, including Yang Yugang from the Zhuozhou City Domestic Security Team. His arrest was retroactively approved on August 19th of the same year. He was then sentenced to three years in prison by the Zhuozhou Municipal Court on May 27th, 2011. Mr. Lu Jinyou filed an appeal, but the Boading Intermediate People's Court ruled to uphold the original verdict.

According to reports, during the hearing at the Zhuozhou Municipal Court, Mr. Lu faced the judge and stated in an upright manner: “I did not break the law by practising Falun Gong, and I did not undermine law enforcement. Falun Gong books are used to guide us in our cultivation, and Falun Gong materials exposing the persecution are used to tell people about the facts. My actions have not brought any harm to society and neither will there be harmful consequences, so I cannot admit to the conviction and demand my immediate release.”

Mr. Lu Jinyou's defence lawyer from Beijing pleaded “not guilty” and rendered the prosecutor speechless and unable to respond. The trial judge, Zhang Xiaoli, tried to stop the defence lawyer from speaking by cursing loudly.

According to family members who witnessed what happened in court, Mr. Lu Jinyou's hands were cuffed behind him through the entire hearing. Originally tall and healthy, he had become pale, thin, and hunchbacked after months of torture. He was nearly unrecognizable to his family members.
