Geneva: Prosecuting Wang Yusheng, a Prime Culprit of Inciting Hatred

In April 2004, at the U.N. Human Rights Conference, Falun Gong practitioner Ms. Yoko Kaneko, who was recently released from a forced labour camp in China and was invited to give a speech at a forum on women’s rights in the UNHRC, recognised and identified a man who incited cruel torture and brainwashing in China but attended the UNHRC as a member of the non-governmental organisation “United Nations Association of China” (UNAC).

Yoko Kaneko, who currently lives in Japan, was sent to a female forced labour camp in Beijing and was persecuted there for one and a half years without trial, simply because she handed out flyers exposing the facts about the persecution of Falun Gong. Yoko Kaneko suffered from cruel torture during her imprisonment in the forced labour camp. She recalled that during her stay in the labour camp a guard played a video tape. In the video the guard reviewed the technical development of his “transformation” of Falun Gong practitioners by means of brainwashing, and made a conclusion that in the initial stage it was very difficult to transform Falun Gong practitioners, but he finally found a variety of approaches afterwards. Wang specifically recommended that the use of sleep deprivation is an effective approach.

After identifying photos, this man turned out to be Wang Yusheng, who is the Secretary General of the “Chinese Anti-Cult Association” (CACA). Given the above, the Swiss Falun Gong Association contacted the “World Organization to Investigate the Persecution of Falun Gong" (WOIPFG). As revealed by the WOIPFG, they have also kept an eye on this man. According to the WOIPFG’s report, Wang Yusheng’s official title is the Curator of the Chinese Science and Technology Museum, and he is one of the founders of CACA. Both the CACA and the Chinese Love and Care Association are registered under the Chinese Science and Technology Museum, and Wang is the legal representative for these two organisations.

The WOIPFG’s report indicated, “The members of CACA have been using their religious and scientific backgrounds to provide suggestions to the Chinese government regarding the methods of persecution, and offer theories to criticise Falun Gong's principles, as well as directly participate in various persecution activities including the transformation of Falun Gong practitioners.”

On public occasions, Wang refers to himself as a scientist, but in reality he is the Jiang regime’s media manipulator in the persecution of Falun Gong. He mainly focused his energy on inciting hatred against Falun Gong in China and overseas to justify the illegal persecution. He is a prime culprit of spreading hatred against Falun Gong. Since 2001, Wang has made it to the UNHRC in Geneva every year to propagate the hatred and smooth over the facts about the persecution of Falun Gong. But due to a lack of further direct evidence, he has yet to be prosecuted.

According to the information provided by Yoko Kaneko and after consulting with lawyers, Wang Yusheng’s act of inciting cruel torture has certainly violated the United Nations Anti-torture Treaty. Therefore, the Swiss Falun Dafa Association has initiated an overall legal action right away. They decided to file a collective lawsuit against Wang and have received positive responses from the legal profession in Geneva. Seven lawyers agreed respectively to accept this lawsuit filed by seven Falun Gong practitioners against Wang Yusheng. They planned to prosecute Wang Yusheng and appealed to the prosecutor’s office to arrest Wang Yusheng for investigation.

The seven lawyers who have accepted the lawsuit against Wang Yusheng are Mes Mauro Poggia, Philip Grant, Doris Leuenberger, Delphine Gonseth and Franois Canonica, Olivier Cramer, Yal Hayat and Yves Bertossa. On April the 16th, the representative of those lawyers formally announced this lawsuit at a press conference held at the United Nations.

In the press conference, lawyer Bertossa said, “China and Switzerland are signatories to the United Nations Anti-torture Treaty. All the signatories have an obligation to arrest and detain the related criminals.”
Lawyer Hayat revealed, “The Geneva State procurator has accepted this suit.”

According to a concerned official in the Swiss Government, because Wang Yusheng came to Switzerland in the capacity of representative of a non-governmental organisation, he has nothing to do with immunity; once an arrest warrant is issued, it can be carried out immediately.

But Wang Yusheng hasn’t showed up in the United Nations again in the last few days….

Lawyer Hayat said, “If the legal process lasts too long the defendant could escape from the country upon becoming aware of the lawsuit against him. Nevertheless, if the defendant enters Switzerland again, he will be the subject of the lawsuit again.”

In 1998, pursuant to a Spanish judge’s request, the U.K. police arrested the former Chilean President Augusto Pinochet, who was in the U.K. for medical treatment at that time. Pinochet was accused of murder, inflicting cruel torture and genocide. In 2003, a German court issued an arrest warrant against the Former Argentine dictator Leopoldo Galtieri and another two people on charges of murder. In January, 2004, in accordance with an arrest warrant from Germany, Argentine police already arrested three defendants including Galtieri, who has been under house arrest because he is as old as 78. These cases signified that the international law certainly has gone to its implementation stage.

Besides, in 2003, International Criminal Tribunal for Rwanda convicted three Rwandan media officials of both inciting genocide and crimes against humanity. Two were sentenced to life imprisonment, and another to a jail term of thirty-five years. This case marked the first punishment on those who incited hatred.

In this year’s U.N. Human Rights Conference, human rights education became an important topic, in which participants mentioned that hatred education is the fundamental cause of long-term national conflicts and regional disputes. In terms of putting the persecution of Falun Gong to an end, the punishment of this hatred-inciting Wang Yusheng symbolizes a fairy important meaning. The only purpose for this persecution against Falun Gong is to eradicate this spiritual belief, and it is against human rights. The instillation of hatred and the eradication of traditional moral belief in “Truthfulness, Compassion and Forbearance” promoted by Falun Gong are the major causes for the on-going moral degeneration and unrest of the Chinese society. Internationally, to prevent any western religion and democratic thoughts from influencing people in China, the Chinese authorities have regarded all the advanced western countries as subversive anti-China western forces. Falun Gong is being deemed to be supported by the anti-China western forces, so as to incite hatred among all Chinese people. To spread hatred in such a country with a huge population, the consequence would be unpredictable once a violent conflict occurs. This is indeed the most serious threat to international peace as well as this region.

Since Wang Yusheng is violating international law, he can be indicted in the jurisdiction of all these signatories to the international treaty. It appears that Wang should have second thoughts before he plans to go abroad again.
