The "610 Office" and Guangzhou City Court Conduct an Unfair Trail of Ms. Xie Kunxiang

On August 3, 2004, at noon, Falun Dafa practitioner Ms. Xie Kunxiang was reported to the police because she was distributing leaflets exposing the persecution. The police arrested her and took her to the Haizhu District Detention Centre.

On January 24, 2005, at 3 p.m., the Haizhu District Court held Ms. Xie's trial. Around 3:20 p.m., the procuratorate brought Ms. Xie Kunxiang from the detention centre to the Haizhu District Court. When Ms. Xie got out of the police van she shouted loudly, "Falun Dafa is good! Falun Dafa is a righteous practice!"

Personnel from the Haizhu District "610 Office" (1), which was the "public prosecutor" in this case, didn't show up until 4:30 p.m. They delayed the trial by more than an hour without any reason. When the session started, Ms. Xie continued to speak boldly about Falun Gong and demanded justice from the court. The public prosecutor said, "Xie Kunxiang, you are practising Truthfulness, Compassion and Forbearance. I hope you can answer my questions based on the facts." Ms. Xie met the leading questions, designed to create false evidence against her, with silence. When the 610 Office asked questions that involved slandering Falun Gong, Ms. Xie called out, "Falun Dafa is good! Falun Dafa is a righteous practice!" When the public prosecutor's inquiry was finished, Ms. Xie denied all of the statements that the public prosecutor made.

Afterwards, the defence lawyer started to examine Ms. Xie. However, when the attorney asked her why she practised Falun Gong, or asked her questions about the cultivation practice and other related questions, the judge stopped him arbitrarily. The judge claimed that this line of questions had nothing to do with the case. The defendant's answers were very important to the trial, but the judge intentionally discarded all such evidence.

When the defence lawyer questioned the "evidence" submitted by the 610 Office, the public prosecutor always used the excuse that the Party could not coordinate with him and asserted to the court that their "evidence" was reliable. When the defence lawyer requested to examine the contents of the flyers that Ms. Xie Kunxiang had handed out, instead of providing the flyers to the court, the 610 Office only provided a piece of paper which they said could not be made public. The 610 Office even took that piece of paper back immediately after the attorney only had a quick look at it.

Facing the unfair trial, Ms. Xie spoke out righteously and sternly, "Why are you afraid of publicising our Dafa? Why are you afraid of publicising what our teacher has said? Why are you quoting out of context? Why are you insulting our teacher?" The judge got extremely angry when she spoke. He responded, "Xie Kunxiang, it looks like if I don't sentence you to 3 years, you are not going to be compliant." A judge should uphold justice, but he spoke as if he could sentence her even before the case was finished. When a judge who is supposed to uphold the law actually does this, isn't he actually breaking the law himself? Hastily the judge closed the trial. As the staff of the procuratorate dragged Ms. Xie back to the police van, she shouted loudly, "Falun Dafa is good! Falun Dafa is a righteous practice!"

On April 12, 2005 at 3 p.m., the Haizhu District Court was going to have a session to announce the trial result. The result is not yet known.

(1) "The 610 office" is an agency specifically created to persecute Falun Gong, with absolute power over each level of administration in the Party and all other political and judiciary systems.
