Ms. Zhang Xinyi from Hunan Province Unjustly Sentenced to Three Year Prison Term

It has been reported that after 51-year-old Falun Dafa practitioner Ms. Zhang Xinyi from Changsha City was tried secretly on August 4th 2005, she was sentenced to three years in prison by the Tianxin District Court in Changsha City.

The reasons for Ms. Zhang's sentence are as follows.

1. She once distributed leaflets exposing the persecution about Falun Gong at Xintian Elementary School in the Tianxin District, Changsha City.


2. She once distributed leaflets exposing the persecution about Falun Gong and the Nine Commentaries on the Communist Party in Baoziling Community, Tianxin District.

3. Police from the Tianxin District Public Security Sub-bureau claimed that they uncovered some leaflets exposing the persecution, a computer, a printer, and other equipment in Ms Zhang's dwelling. According to the above, Ms Zhang was sued for violating criminal law article 300 and the so-called "obstruction of criminal law."

In 2004 the Tianxin District Court determined that practitioners Ms. Tan Xiangyu and Ms. Deng Chaogang from the Tianxin District were guilty as well as Ms. Zhang Xinyi. The emphasis of the trial was on the defendant's breaking of the law, but the unlawful conduct of the law-enforcement agents was completely ignored.

For example:

On April 8th 2004, Ms. Tan Xiangyu and Ms. Deng Chaogang's trial took place, but the court did not inform their family members of the trial. Some of their relatives and friends went all over to enquire where the trial was going to be held, and only then were they able to appear in court.

On August 4th, 2005, when it tried Mrs. Zhang, the Tianxin District Court did not inform Ms. Zhang's family members, either. In addition, they strictly blocked the news. The 125th article in China's Constitution clearly states that when the people's court tries a case, all proceedings are conducted publicly. However, the family members were not even informed.

In June 2004, Ms. Tan Xiangyu's relatives went to the Tianxin District Court to get a written judgement and prepared to appeal, but they encountered obstacles created by Judge Chen Xinzheng, who did not issue a written judgement for a long time. It took more than half a month. The written judgement was obtained only upon her relatives' repeated request. Judge Chen Xinzheng's actions obviously obstructed the process of appeal by Ms. Zhang's relatives.

This time Judge Chen Xinzheng again presided over the illegal sentencing of Ms Zhang Xinyi. Some of the people who presented evidence and thus participated in persecuting Ms. Zhang were surnamed Gong, Xu, Yuan from Xintian Elementary School in the Tianxin District, Huang, Tang, and Guo from the Baoziling Community in the Tianxin District.

Ms. Zhang has been imprisoned in Changsha jail close to five months. During this time, she has always persisted in the righteous belief of Dafa. She once fasted to protest the illegal imprisonment. Now, Ms Zhang has appealed to the Changsha Intermediate Court and requested that the first trial decision from the Tianxin District Court be rescinded.
