Disabled Practitioner's Compensation Claim Ignored in Zhejiang Province

Falun Dafa practitioner Fan Zhongzhuang has suffered severe persecution on two occasions. While in Jinyun County, Zhejiang Province, he was arrested and sentenced to four years of forced labour. Then on August 9th, 2005, he was arrested again and his home was ransacked. This time, he ended up totally disabled from torture. Advocate Fan Ziliang, who is appealing for justice on behalf of Fan Zhongzhuang, submitted a letter warning County Security Captain Li Jinliang and his accomplice police officers that they would have to pay for their crimes.

Below is a summary of Fan Ziliang's letter, and a compensation claim on behalf of Fan Zhongzhuang.

To County Security Officer Captain Li Jinliang and other police officers:

On August 9th, 2005, Falun Dafa practitioner Mr. Fan Zhongzhuang was arrested at his home by National Security officer Li Jinliang, Town Law Officer Wang Shigen, and over ten other officers, without proper legal papers. He was then put in a detention centre where he was interrogated by torture. For five days and nights, eight people taking took turns interrogating him.

Under this gruelling trial, Mr. Fan finally collapsed. His family was then informed that he had fallen from a three-metre-high building, causing him to become permanently disabled.

According to the report, Fan Zhongzhuang's disability was a result of falling from a three-metre-high building. However, an investigation revealed that, for the entire time, Fan Zhongzhuang had been under interrogation in the detention centre, which was located on the ground floor. (In fact, detention centres throughout the country are located on the ground floor.) The report was therefore suspicious. It was obvious that his bodily injuries were caused by torture. Because of severe injury to his chest, Mr. Fan had remained unconscious and was unable to recall what had happened to him on that day. Therefore, the officers accused him of trying to commit suicide.

Moreover, Mr. Fan's immediate family was not informed of the accident until 48 hours after he had been in the hospital. The family was not told about what had happened to him during the 20 days after his arrest.

Mr. Fan was strong and healthy before the arrest. Now he is permanently maimed and has to depend on assistance and spend the rest of his life in a wheelchair.

As a result of torture, Mr. Fan is now disabled, and this account has to be settled. Lishui Tianping Solicitors have reviewed the case, and issued a list of claims on his behalf. The claim does not include compensation for his mental suffering. Mr. Fan was in the prime of his life before the incident. Had he not been mistreated, he could have brought greater wealth to society and to his family. Instead, his family must support him for the rest of his life.

We are amazed that Deputy Chief Police Yang Changchun responded to this claim by stating, "The compensation claim is way out of line. If you want compensation, we will agree to 10 thousand yuan1, but you must first pay 20 years of interest on it initially." He was just playing games. It was also pointed out that during Mr. Fan's hospitalisation, the police tried to stop the hospital administration from giving him further medication. Since August of last year, Mr. Fan has not been paid the nursing fees due to him, which amounts to a total of 4,200 yuan.

To date nothing has been mentioned about the Fans' compensation payment.)


Update:

On May 13th, 2007, Fan Ziliang learned that when Mr. Fan Zhongzhuang submitted his claim for nursing fees for the past 12 months from Jin Yun Police Department, Deputy Officer Yang Changchun passed the buck to the chief officer. Local media were informed of the case but are reluctant to help, hinting at its sensitivity. Because of that, Mr. Fan Zhongzhuang is now uncertain about whether he should remain in treatment at the hospital. However, despite the fact that the hospital was providing next-to-no-service, advocate Fan Ziliang feels that they should continue to fight for their rights.
