As you know, the United States Government has intervened in the case, urging dismissal of the lawsuit. The government alleges that this action under the Alien Tort Claim Act and the Torture Victims Protection Act infringes on the right of the President to conduct U.S. foreign policy. I strongly disagree with the government's position in this matter. These laws give concrete expression to America's commitment to human rights. If the United States is to have international credibility when it speaks on human rights, it must uphold these laws and permit the courts to consider and enter judgments in cases like this one.
As you may also know, several Members of Congress have submitted an amicus curiae brief in support of the plaintiffs. I asked that my name be included on the brief, but unfortunately the brief was submitted before I had the opportunity to sign it. You can be sure that I support access to the U.S. courts to hold human rights abusers accountable under the Alien Tort Claim Act and the Torture Victims Protection Act.
