After a two hour hearing on June the 6th 2006, the Criminal Division of the Spanish Supreme Court made its final decision to uphold an appeal submitted by Falun Gong practitioners who survived the alleged genocide instigated by top Chinese government officials since July 1999.
The original lawsuit, filed with the National Court on September the 2nd 2004, accused Jia Qinglin, China’s incumbent Chairman of the Standing Committee of the National People’s Congress, for being responsible for carrying out tortures and persecution against more than one hundred thousand innocent Falun Gong practitioners when he served as the Secretary of Beijing Municipal Party Committee in 1997 and 2002. On the eve of Jia’s visit to Spain between September the 3rd and the 7th 2004, the Spanish Falun Dafa Association filed the lawsuit, accusing him of committing crimes of genocide and tortures.
The historic decision of the Supreme Court was made based on Spain’s principles of international jurisdiction without victims of Spanish nationality. The same principles have been cited in the prosecution of the genocide in Guatemala. Without a doubt, this is a gigantic step in the circle of international jurisdiction. It is also a victory for the victims of the alleged genocide. This historic step has important significance to those criminals who commit dreadful crimes but remain at large because of the harbouring of the Chinese communist regime.
Owing to the lack of independence in China’s judicature, the Chinese communist regime would prohibit any investigation or trial against criminals under its sovereignty. Without resorting to international judicature, it is impossible to bring these criminals to justice.
The prime culprit who ordered the persecution and genocide against one hundred million Falun Gong practitioners is the former Chinese President, Jiang Zemin. He set up a so-called “6-10 Office” specifically to persecute Falun Gong practitioners. Jia is one of the members who directly participated in handling the persecution. The ultimate goal of the organisation is to root out the spiritual group. Estimated conservatively, there have been at least two million practitioners illegally imprisoned and brutally tortured in forced labour camps. Among them, more than two thousand people have been killed, including elderly people, women and children. This persecution is the most extensive attempt at genocide committed in modern times.
As revealed by an independent witness recently, there are thirty-six concentration camps in China where imprisoned Falun Gong practitioners are treated as “organ banks of live bodies”. Practitioners’ organs are harvested and sold on the black market. The degree of the persecution instigated by the Chinese regime continues to escalate.
The Spanish Falun Dafa Association gives high praise to this rightful decision of the Supreme Court. It can help to stop the genocide which has caused immeasurable terror to a hundred million people during the past seven years. It is hoped that this is the starting point of terminating the persecution and that all of the criminals responsible for the persecution are brought to justice.
