Who is Obstructing the Implementation of China's Laws?

On July 20th, six years ago, a brazen fool colluded with the Chinese Communist Party (CCP), and led China into an extremely dark stage of history, bringing endless disasters to the Chinese people.

For the past six years, the evil CCP has used the most despicable means to brutally persecute Falun Gong practitioners who believe in "Truthfulness, Compassion, Forbearance." The CCP's dictates are above the Chinese law, they are vicious, and they have the effect of suppressing the conscience of the Chinese people. In addition to its obviously unlawful methods, such as illegal detention, ransacking and searching homes without a warrant, illegal fines, torture, etc, the CCP takes advantage of the law to appear legitimate.

Let us look at the CCP's infamous crime of "using an evil cult organisation to disrupt the implementation of the law." This so-called law was ratified by the National People's Congress and then used by all levels of the judiciary to prosecute Falun Gong practitioners. Who is really the evil cult? It is not Falun Gong. The Nine Commentaries on the Communist Party has thoroughly analysed the facts and proven that the CCP is an evil cult. Jiang Zemin has been using the CCP to destroy the correct implementation of Chinese law and to trample on human rights in China.

Implementation of the law means putting legal statutes into practice, namely the law is complied with, enforced or applied to everyone fairly. Disrupting the implementation of the law means that legal statutes cannot be applied fairly and consistently, and the people's rights as defined under the law are not able to be safeguarded. In this situation the authority given by the law is weakened and becomes non-existent. In China today and throughout the history of CCP rule, disruption with the implementation of the law has become common-place and omnipresent.

In this world, the only political party that could possibly ignore all rules and principles, treat lying as second nature and conduct itself shamelessly, is the CCP. No other political party can beat it at destroying the law.

In a modern society, ruled by law, laws are considered sacred. Even in a traditional society, the law of the land was supreme. This is a principle for all nations and all generations. However, since the CCP, with its rogue nature and masquerade of Communism, is not practising Communism, and instead does whatever it wants, it disregards and destroys legal rules at will. Moreover, the most devastating effect of the CCP rule is that it instills extremely evil anti-humanity concepts into the Chinese populace. It causes the Chinese people to become numb and accustomed to the destruction of their legal framework. Thus, we may argue that in modern China, if anyone stands up to protect the dignity of the law, it would be considered unusual.

In today's countries, the rule by law is restrained by the respective countries' constitution, and the constitution contains the fundamental inviolate principles. Rights granted under the constitution are initially derived from democratic authorisation. Therefore, the constitution itself, acting as the supreme law of the country, must be legislated or amended by elected bodies under strict directives and procedural control. The legality of all state power comes from the authorisation granted by the constitution. All state power, regardless of the legislative power, executive power, or the jurisdiction, is thus limited and restricted by the constitution. To safeguard the constitution, each country has a set of checks and balances that seek to prevent constitutional violations and safeguard the freedoms bestowed to its country's citizens.

In China, enactment and amendment of its constitution is only superficially passed by the National People's Congress, which is then boasted as a body that is democratic. In actuality, every amendment and all content--not even a word of the Chinese constitution--is written or amended by the National People's Congress. All constitutional changes are drafted by the party's evil spirit and given to the National People's Congress as a mere formality. When the constitution was amended last year, the National People's Congress only changed a punctuation mark to smooth out a sentence, and did not change any meaning. This action was called a "great leap forward" by some Chinese constitution scholars.

Many fundamental human rights, which are most needed by the Chinese people, are still missing from the pages of the Chinese constitution. These rights include the right to move freely within the country, the right to hold property and the right to checks and balances that guard against violations of the constitution.

Though the so-called constitution has been written by the CCP, aside from the clause stating that the CCP leadership is to be sustained indefinitely, all other laws included in the constitution are consistently violated and trampled on by the CCP. The constitution bestows religious freedom, but the CCP does not allow freedom of belief to the Chinese people. They have destroyed and interfered with the three traditional religions of Taoism, Buddhism and Christianity and they systematically and brutally persecute Falun Gong. The constitution bestows on people freedom of assembly, parade and demonstration. Yet later, the evil party ordered the National People's Congress to pass a law precisely to regulate and violate this freedom. The constitution says that the judiciary is independent of the country's administration, yet after so many years of so-called judicial advancement, China has never exercised jurisdictional independence. According to China's legislative law (constitutional law), rules that limit personal freedom can only be formulated within the law, and only the National People's Congress and its Standing Committee are authorised to legislate such a rule. However, the illegal administrative rule of "education through forced labour system" has existed for a long time and is being used extensively in violation of this constitutional statute. Education through forced labour can restrict personal freedom for up to three years, which is even longer than the legal punishment allowed under criminal law. Throughout the years many good-intentioned citizens have submitted written statements to the National People's Congress Standing Committee to suggest the abolishment of education-through-forced-labour. But the Standing Committee, always a tool and accomplice of the CCP, has consistently ignored such statements. Although the constitution has granted the Standing Committee the status of highest authority, it has never exercised its highest state power on its own initiative. It is in actuality an ornament and tool of the CCP evil spirit.

Regarding other ordinary laws, the CCP has ruthlessly destroyed them and disregarded them without even blinking an eye. Over the past ten-plus years, with the help of the international community, China has indeed established a more comprehensive legal framework, but, this is now used only as a smokescreen. The reality is that people's rights written in the law have never been safeguarded. The CCP supersedes all laws with its power, and it does not have to adhere to any legal restrictions. Networked throughout the country, all Chinese governmental entities also act according to the CCP's will.

According to the law, the National People's Congress should hold the highest power of the land, but it has no ability to exercise them. The evil party can pass any law it wants and elect officials at will.

The judiciary should be the symbol for social justice and the ultimate safeguard for social fairness, but its "independent" status exists in name only; it cannot possibly act independently. China's judiciary has never been independent of the administration. Whomever the evil party wishes to sentence, the judiciary must give its signature of approval. The judiciary is forced to ignore existing legal regulations and all considerations toward fairness and justice. Under the leadership of all levels of party committees, every level of administration obeys the wicked party without objection. Therefore, legal rights will not become a reality in China. Should anyone wish to seek relief for violations of human rights, they face brutal persecution from the wicked party and its watchdogs.

What is most repulsive is that to suppress Falun Gong, the CCP has set up a new illegal organisation, called the 610 Office. The 610 Office has absolute power over all local and national agencies. It can deprive citizen's legal rights at will. The National Public Security Bureau as well as all supervision and judiciary government offices do not take existing rules as law, but obey all of CCP's secret orders. The CCP imposes forced labour, arrests, sentencing, fines, torture and murder. The country's fundamental laws under the constitution, all criminal laws, criminal procedural laws and administrative punishment laws are not worth the paper they are written-on. The country, constitution, laws, rights and all official speeches are empty words.

A German scholar, Rudolf von Jhering, said in his novel, The Struggle for Law, that people without rights are no different than domestic animals, and that Roman slaves were traded as domestic animals. The Chinese people have been treated just like Jhering said. Chinese people are not granted any fundamental human rights. But, what is most regretful, the majority of the Chinese people no longer resist it and have become helpless. They choose to silently endure, approve of such treatment and tolerate it.

Yet, despite such wickedness, Falun Gong practitioners have lived through a six-year reign of terror, and have responded peacefully. They have diligently and tenaciously persisted in their beliefs, defended human conscience and dignity, and have upheld their rights as well as their legal dignity.

Today, six years later, the evil CCP has already reached a dead end, while Falun Dafa has spread worldwide and is practised in 78 countries.

Since that summer in 1999 when the persecution against Falun Gong was declared, "China's dream of being ruled by law has been trampled on and became an empty dream." China is facing a real disaster. On the other hand, since July 20th, 1999, Falun Gong practitioners' diligence and tenaciousness, and their righteous faith and courage has shocked the world, and has finally brought genuine and newfound hope to the Chinese people.

This hope is drawing closer to China with every day that passes. We have already seen the daybreak after the long dawn.
