Practitioner Ms. Cui Hongyan from Daqing City, Heilongjiang Province Is Arrested

At about 8:00 a.m. on November 1st, 2006, practitioner Ms. Cui Hongyan was arrested by police from Tieren Public Security Sub-bureau and Youyi Community Police Station in Daqing City, Heilongjiang Province.

Recently, more than 30 of Ms. Cui's relatives filed a petition to the appropriate judicial department, challenging the legality of her arrest. They reasoned that her practice of Falun Gong was a right to personal belief guaranteed by the Constitution. They argued that sentencing her to prison was illegal. Tieren Public Safety Sub-Bureau and its officers were therefore illegally arresting good citizens, which is clearly against the law. Ms. Cui Hongyan's relatives demanded her unconditional release and promised to hold responsible those in violation of the law.

The petitioners were: Cui Hongyan's relatives: Cui Jincai, Wu Guiqin, Wang Yuxiang, Yuan Yi, Yuan Baocai, Cui Honglan, Cui Jinzhi, and many others.

Main content: Filing a petition in protest of the arrest of Ms. Cui Hongyan, which was approved by Saqu's Prosecution Court (order number 625 [2006]).

Facts: On November 1st, 2006, Ms. Cui Hongyan, an innocent 43-year-old Water Supply Company employee, was arrested by policemen Zhang Jiqing, Chen, and Guo from Youyi Community Police Station of the Tieren Public Security Sub-Bureau. Family members appearing at the scene strongly protested the arrest and demanded to see the director of the bureau, Sun Xiufan. They questioned the legality of the so-called "security deposit" of 10,000 yuan1 and the confiscation of a computer last year. Zhang Jiqing said that the police would not acknowledge or take responsibility for such a thing.
At about 9:00 a.m. Ms. Cui was dragged into a police car. Her sisters tried to rescue her, but they were knocked to the ground by officer Zhang Jiqing. Ms. Cui was taken to Tieren Sub-Bureau, where she was tied to a metal chair with both hands cuffed behind her back. While she was handcuffed, the police attempted to obtain fingerprints, but she did not cooperate with this procedure. Her relatives were asked to sign documents, but they all refused. Police threatened the them by telling them, "You have committed the crime of attempting a cover-up and will be arrested for it." Her family members informed the police that the victimizing of good people would bring them misfortune. Ma Yunming responded, "Since the Communist Party pays me 500 yuan for each Falun Gong practitioner I arrest, I will become quite rich if I arrest ten of you."

When one relative called Director Sun Xiufan regarding the return of the 10,000 yuan that was extorted last year, Sun relied, "The statute of limitations on that has passed." Police not only extorted large sums of money, but also victimized Cui Hongyan by locking her up in the Daqing Detention Centre for a month without allowing family visits.

The "notice of arrest" identified the crime as "being involved in an illegal activity." This was untrue and unfounded. Our country's Constitution clearly states: "Citizens of the People's Republic of China have the right to freedom of speech, publication, gathering, forming of a party, freedom of religion, parade, and demonstration."

Ms. Cui Hongyan was frail with many illnesses since childhood. The joints of her hands, feet, and legs began to swell and enlarge when she was quite young. In 1994 she was struck by a Water Supply Company truck, and she ended up in a coma. Doctors indicated she would be paralysed for life and require expensive medical treatment. In 1997, soon after starting to practise Falun Dafa, miracles happened! She was able to walk, and six months later all her illnesses disappeared! Neighbours and colleagues were surprised. She cultivated herself as a true practitioner, living her life according to Falun Dafa's principles "Truthfulness, Compassion, Forbearance" and thinking of others before herself. Her colleagues and superiors alike appreciated and admired her.

Since July 1999, when the persecution of Falun Gong began, Ms. Cui Hongyan, a good person, has become a target of this persecution. She has done nothing wrong! She has benefited from practising Falun Gong and regained her physical and mental health. How could being a good person be wrong? If she had not practised Falun Gong, she would have been dead long ago.

We are concerned for Ms.. Cui Hongyan and her family. Her son is still in high school and will soon take the college entrance exams. He worries every day in school and thinks about when his mother will return home. Cui Hingyan's 80-year old mother-in-law fell ill when she heard that her daughter-in-law had been arrested. Her parents, over 70 years old, have been tearful every day while visiting different departments trying to enquire as to when their daughter will return home again. They have not received any encouraging answers and no one will take responsibility for their daughter's predicament.

Ms. Cui Hongyan is practising Falun Gong, her personal belief guaranteed and permitted under the Constitution. Therefore, arresting her is not legal and sentencing her to prison is not warranted. Those officials from Tieren Public Security Sub-Bureau (Sun Xiufan, Ma Yunming, Cui Enzhong, Zhang Jiqing, and others) have violated Articles 238, 243, 245, 247, 248, 397, and 399 of China's Constitution. They have committed crimes including: illegal arrest and imprisonment, providing false evidence, illegal search and interrogation, extorting a confession, obtaining information by torture and terror, mistreating a detainee, illegally depriving a citizen of freedom of belief, excessive use of authority, etc. We have identified our legal rights, acknowledge the responsibility of police officials in this matter, and demand the immediate and unconditional release of Cui Hongyan.
