Engineer Arrested before Olympic Games; Family Files Suit Against Persecutors

Mr. Yang Jianzhong, 70, was awarded the title of "outstanding cost engineer". On August 7th, 2008, just before the Olympic Games, he was arrested by local police officers and Chinese Communist Party (CCP) agents, and his home was searched. More than 90,000 yuan¹ in cash was seized from his home and he was detained at the Wenjiang District Detention Centre. Fifteen days later, he was transferred to the notorious Xinjin Brainwashing Centre, also known as the Chengdu City Legal Education Centre. Several days ago, he was taken to a hospital in Wuhou District of Chengdu City. Jia Xiaodong, director of the Security Division of "7111 Plant (War Preparation Corp)", personally conducted the brainwashing of Mr. Yang.

Below is the lawsuit that Mr. Yang' s son filed.

Plaintiff:

Yang Yifan, male and of Han nationality, lives in the "7111 Plant" Family Housing in Wenjiang District, Chengdu City, Sichuan Province.

Defendants:

1. Police officers from the Gongping Police Station in Wenjiang District, Chengdu City
2. Wang Hongtao, Jia Xiaodong, Liu Xu, Wu Tao, of the "7111 Plant" Security
3. All personnel at the Xinjin Brainwashing Centre located in Huaqiao Town, Xinjin County, including; Li Feng, Yin Shunyao, Bao Xiaomu, Wang Hongqiang

Facts and Reasons

My name is Yang Yifan. I am 37 years old and I am the son of Mr. Yang Jianzhong. On the morning of August 7th, 2008, as my father was just coming home from being out of town, Liu Xu, from the Security Section of "7111 Plant", was waiting for him. My father walked up the stairs and before he entered his apartment, Wu Tao, Liu Xu, and police officers from the Gongping Police Station seized him and handcuffed him from the back. They photographed him from different angles before wrestling him into a police car. The arresting officers came in three police cars and two vans. Later, my father was taken to the Wenjiang District Detention Centre. Meanwhile, the key to my father's house was taken and his home was searched. His lifetime retirement pension of 92,000 yuan cash, was confiscated. I have not received any legal documents about this money.

My father Yang Jianzhong is 70 years old and a Falun Gong practitioner. He was a senior cost engineer at the "7111 Plant" under the Aerospace Department. He was awarded the title of "outstanding cost engineer" of Sichuan Province.

Before he practised Falun Gong, he suffered from many ailments such as gastric disease and dizziness. He would frequently faint in the toilet. In 1996, he began to practise Falun Gong and followed the principles of "Truthfulness-Compassion-Forbearance". Consequently, there was a noticeable improvement in his mental and physical health. This saved the plant many medical expenses. However, under the control of the CCP, the authorities of the plant issued an order that he be taken to the Xinjin Brainwashing Centre in March of 2008. Being forced to leave home after learning about the detention, my father left home at the beginning of April 2008.

We heard that it was because of the Olympic Games that the plant made plans to detain my father. That is a violation of the law and the Constitution. Both the Olympic Games and Paralymic Games are over, but my father still remains in custody. In late August 2008, he was transferred to the Xinjin Brainwashing Centre and subjected to abuse. For two months, we did not receive any legal documentation about his arrest. We learned that he was taken to a hospital in Wuhou District and that he was subjected to overdoses of drugs. The persecutors claimed that he had developed an incurable disease, but this information was not disclosed to our family.

The defendants took Mr. Yang Jianzhong to the Xinjin Brainwashing Centre in late August 2008. This was a violation of the 238th article of the Criminal Law, and the crime of detaining an innocent person was committed.

Police officers from the Gongping Police Station and Liu Xu from the "7111 Plant" took Mr. Yang Jianzhong's house key without showing any ID. His home was searched without a warrant--a violation of the 245th article of the Criminal Law and the crime of performing an illegal search was committed.

Police officers from the Gongping Police Station seized Mr. Yang Jianzhong's retirement pension of 92,000 yuan cash: a violation of the 263th article of Criminal Law and the crime of burglary was committed.

Police officers from the Gongping Police Station brutally beat Mr. Yang Jianzhong. That violated the seventh section of 22th article, beating people or inciting others to beat people. This was a violation the 234th article of Criminal Law and a crime of intentionally injuring another person was committed.

The personnel of the Xinjin Brainwashing Centre were under suspicion of violating the following articles of the Criminal Law: 251th article, the crime of depriving a person of freedom of belief; the 269th article, the crime of confiscating personal property; the 237th article, the crime of insulting women, the 234th article; the crime of intentionally injuring a person; and the 232th article, the crime of committing murder. I hereby file the following accusations and put forward the following requests:

1. Immediate release Mr. Yang Jianzhong

2. Immediate return the 92,000 yuan

3. Submit a case file on the investigating police officers from the Gongping Police Station who are suspected of committing burglary, performing an illegal search, intentionally injuring a person, and illegal detention of an innocent person.

4.Submit a case file on the investigating officers: Wang Hongtao, Jia Xiaodong and Liu Xu, who are suspected of committing burglary and responsible for illegally detaining a innocent person.

5.Submit a case file for the investigating personnel at theXinjin Brainwashing Centre, including: Li Feng, Yin Shunyao, Bao Xiaomu, Wang Xiuqin, Xu Dan, Wang Hongqiang, Huang Zhongzhi, Wu Yabo, Chen Songtao, Jiang Hongliang, Hu Sixue, Yang Xiumei, Dai Gong, and Liu Deming, who are suspected of committing the following crimes: illegal detention, denial of freedom of belief, confiscation of personal property, intentionally injuring a person

6.Monetary compensation for all losses incurred by the defendants which include medical expenses, loss of physical health and strength, salary loss, and mental anguish.
